Summary:
Client is seeking to expunge an indictable offense. Expunging that record will enable him to seek better employment.
Client was arrested in Jersey City on April 3, 2009 and charged with five different counts of possession and distribution of CDS. He subsequently pled guilty to one of the possessory charges and the other four were dismissed. He was sentenced by the Hudson County Superior Court to two years of probation and appropriate fines on July 9, 2010. He successfully completed probation within that time period but did not pay off the fines until November 2014.
Subsequently to his drug arrest, Client was arrested by ICE in on May 18, 2011 as a deportable alien. He appeared before an immigration judge in Newark and three months later (August 10, 2011) Cancellation of Removal was granted.
Client is licensed as a Certified Nursing Assistant/Aide in California. He been denied employment as a result of his criminal record. He would like to return to work but his record has been a barrier to securing employment. Client is eligible for a public interest expungement having satisfied the five-year waiting period after completing probation.There may be some communication difficulties in assisting Client as he suffered a stroke 3 years ago and his speech is slurred. But Client cannot proceed on his own and expunging his record may enable him to return to work. He cannot do so on his own.
