Summary:
Client and girlfriend are living together with their 1 year old child. They recently moved to Florida. On July 31, 2021, client was notified by DCPP that she gave birth to an infant. He had no idea that she was pregnant and had no idea that she went to the hospital. DCPP was not clear at first and was evasive when they first called. They gave him very little information.
His partner had given up the baby at the hospital and did not return home with the baby. Hospital called DCPP. Baby was immediately placed in a foster home. Client has never seen the baby to this day. At one point, DCPP asked client to go through DNA test. However, the case worker also warned him that he should not trust the agency that he was told to go take a test because the agency works to the adoptive parents. Client became suspicious of the testing agency and did not take the test. Client assumed that there would be a court process in which he could request a DNA test at a different facility.
Client then received notice for an adoption filing in Surrogate Court. Client went to the hearing on 2/15/2022. Client, girlfriend, and the 1 year old child are currently living in Florida. The baby remains in NJ with the foster/adoptive parents. He does not know the identity of the couple who is attempting to adopt.
Client has never denied paternity. Client states DCPP is still involved with the family but they only monitor the 1 year old. They do not mention or discuss the infant. Client has a hearing on March 29 and cannot proceed with the assistance of effective counsel.
